Introduction
Welcome to the Seer mobile application (the "App"), operated by Seer, Inc. ("Seer", "we", "us" or
"our"). Seer, Inc. is a company registered in Maryland, USA. We respect your privacy and are
committed to protecting your personal information. This Privacy Policy explains what information we
collect from App users ("you" or "users"), how we use and share that information, and your rights
regarding your data. By using the App, you agree to the collection and use of information in
accordance with this policy. If you do not agree with our practices, please do not use the App.
Information We Collect
We collect several types of information from and about users of our App to provide and improve our
services. This includes:
-
Personal Identifiers: When you create an account or profile, we
may collect personal details such as your name and email address. This information is used for
account login, authentication, and to communicate with you (e.g., sending important updates
about the App). If you sign in via Apple Sign-in or Google Sign-in, we receive information from
your social account (for example, your name and email) as permitted by that service. We do not
receive your social account password or more data than necessary – only the basic details
required to set up or log in to your App account.
-
Profile and Sensitive Information: As part of the App's
features, we collect certain personal details you provide to personalize your experience. For
example, you may choose to provide health-related information like your weight and height. You
may also provide personal preferences such as your fashion style/personality details (e.g.,
whether you prefer vintage, bohemian, etc.). These details are considered sensitive personal
data and we only collect them to deliver core App functionality – for instance, to tailor
content or recommendations (such as style advice or sizing guidance) specifically to you.
Providing this information is optional, but it may be necessary for full use of some features.
We treat this data with special care and do not use it for any purpose other than to serve you
within the App.
-
Location Data: With your permission, the App may collect
geolocation information from your device. This is used to provide location-based features,
notably local weather reports within the App. Depending on your settings, this could include
precise GPS location or general location (e.g., city or region). You will be prompted to grant
or deny location access. If you grant access, the App will use your location only to display
relevant weather updates and possibly to tailor the App content to your locale. You can choose
to disable location permission at any time in your device's settings, and the App will then
either use no location data or rely on you to manually input a location for weather information.
-
Device and Usage Information: We automatically collect certain
data about your device and how you use the App. This may include technical information such as
your device model, operating system version, unique device identifiers or advertising ID, and
the App version. We also collect usage data like the features you use, pages or screens you
view, and the times and durations of your activities. This information helps us understand user
engagement, diagnose performance issues, and improve the App's functionality. For example, it
allows us to ensure the App is compatible with various devices and to optimize user experience.
-
Log Data: When you interact with the App, our servers (or
third-party servers on our behalf) may record information ("log data"), including your Internet
Protocol (IP address), the date and time of each request, error logs or crash reports, and
general app usage information. This data is used primarily for analytics and debugging purposes
– for instance, to troubleshoot problems, guard against misuse (such as fraud or security
threats), and analyze overall usage trends.
Children's Privacy: We do not knowingly collect any information from children under
13 years of age. The App is not directed to children, and if you are under 13, please do not use
this App or provide any personal data. If we learn that we have inadvertently obtained personal
information from a child under 13, we will promptly delete it in accordance with applicable laws
like COPPA (Children's Online Privacy Protection Act).
How We Use Your Information
We use the collected information for various purposes in operating and improving the App. These
purposes include:
-
Providing and Personalizing Services: We process your personal
data to deliver the App's core features and content. For example, we use your weight, height,
and fashion preferences to personalize content and recommendations for you, such as suggesting
fashion tips or product sizes that align with your profile. Your location data is used to show
local weather updates, enhancing your experience by providing relevant real-time information.
-
Account Management and Authentication: Your email address (and
name, if provided) is used to create and manage your user account, to authenticate you when you
log in (especially if using Apple or Google login), and to maintain your profile. If you use
social sign-in, we use the info from your Apple/Google account solely to streamline the
login/registration process.
-
Communication: We may use your contact information (like email)
to send important notices or updates regarding the App. This includes verification emails,
password reset assistance, updates to our terms or policies, and notifications about feature
changes. We may also send promotional communications or newsletters about new features or offers
if you have opted-in to receive them – you will have the ability to unsubscribe from such
marketing emails at any time. (We will not send you marketing communications if you have not
agreed to receive them.)
-
Advertisements and Sponsorship: The App displays ads to support
our free services. We may use some of your data to ensure ads are relevant – for instance, using
general location to show region-appropriate advertisements or using non-identifiable
demographics (like seeing that a user is interested in fashion) to allow our ad providers to
present content that might interest you. Any advertising usage of data will comply with
applicable privacy laws and, where required, we will obtain your consent (for example, on iOS
you may be asked for permission to allow ad tracking). See "Third-Party Analytics and
Advertising" below for more details on how advertising networks handle data.
-
Analytics and Improvements: We analyze usage information (such
as device details and in-app actions) to understand how our App is used and to identify areas
for improvement. This helps us fix bugs, optimize compatibility and performance for different
devices, and develop new features and services that better serve our users. For example, we
might analyze which features are most popular or see how users navigate the interface, and use
that insight to enhance the App's design and functionality. We may also use aggregated data
(which does not identify you personally) to research trends or measure the effectiveness of our
content and campaigns.
-
Safety and Legal Uses: We may use information to maintain the
safety, security, and integrity of our App and users. This includes monitoring for and
preventing fraudulent, abusive, or unlawful activities. If necessary, we will use personal data
to enforce our Terms of Service or to comply with legal obligations. For instance, we may retain
and use certain information to meet record-keeping requirements, resolve disputes, protect our
legal rights, or respond to lawful requests from public authorities (such as a court order or
government inquiry).
We will only use your personal information for the purposes described above or for
compatible purposes. If we need to use your data for an unrelated purpose, we will notify you
and, if required, seek your consent.
How We Share Your Information
We understand the importance of your personal information and
we do not sell your data to third parties for their own marketing or commercial
purposes.
We share user data only in the limited situations described below,
and only with parties that ensure the protection of your data:
-
Service Providers and Partners: We employ trusted third-party
companies and individuals to facilitate our App's
services or to perform services on our behalf. This includes, for example, cloud hosting
providers (to store or process data), analytics services (to help
us analyze usage), and customer support tools. These third parties have access
to your personal
information only to perform these tasks for us and are contractually obligated not to disclose
or use it for any other purpose. We ensure that any service providers handling user data have
privacy and security practices comparable to ours.
Third-Party Analytics and Advertising
We use third-party tools to support analytics and advertising in our App:
-
Analytics: We integrate analytics SDKs such
as Google Firebase Analytics and possibly the Facebook SDK to
collect non-identifying data about
how users interact with the App. These tools help us understand usage patterns (for example,
which screens are most viewed, or how often certain features are used) so that we can improve
our product. The information collected by these providers may include your device identifiers,
IP address, timestamps, and events within the App. This data is generally aggregated and does
not directly identify individual users to us. However, these providers may use cookies or
similar tracking technologies within the app environment. We recommend you review Google's and
Facebook's privacy policies to learn how they handle analytics data. We only use such analytics
data for internal purposes of optimization and performance monitoring.
-
Advertising: Our App displays ads through third-party ad
networks such as Google AdMob/Ads (a Google service). These ad
partners may collect certain
device information (e.g., your device identifier/Advertising ID, IP address, general location,
and information about ad interactions) to serve ads that are more relevant to you, to prevent
showing you the same ad repeatedly, and to measure ad effectiveness. Ad networks may use
technologies like mobile ad IDs or similar tracking to manage and target advertisements. No
sensitive personal data (like your weight, height, or profile details) is shared with
advertisers; they primarily use contextual data (like the content you're viewing in the App) or
broad demographics. You have choices regarding personalized ads: for example, you can usually
opt out of targeted advertising by enabling the “Limit Ad Tracking” or equivalent setting on
your mobile device. If you are in a region where consent is required for ad tracking (such as
the EU), the App will prompt you to grant or withhold permission for personalized ads. We only
work with advertising partners that commit to complying with applicable privacy regulations.
-
Social Login Providers: If you use Sign in with
Apple or Sign in with Google to create or log into your account,
certain data is shared between those providers and Seer, Inc. Specifically, we
receive personal data from the provider (like your name and
email) as described in “Information We Collect.” In turn, the fact that you have logged into our
App may be recorded by that provider. We do not share any additional data about your App usage
back to Apple or Google beyond what is necessary for authentication or as otherwise authorized
by you. This exchange of information is governed by the privacy policy of the social login
provider as well - we encourage you to review Apple's and Google's privacy policies for details
on their handling of your credentials.
-
Legal Compliance and Protection: We may disclose your
information if required to do so by law or in response to valid legal requests (for example, a
subpoena, court order, or government demand). We may also disclose information if we believe, in
good faith, that such action is necessary to protect and defend the rights, property, or
safety
of Seer, our users, or the public. This includes exchanging information with other companies and
organizations for the purposes of fraud protection and credit risk reduction (in compliance with
applicable laws).
-
Business Transfers: If Seer, Inc. is involved in a
merger,
acquisition, investment, or asset sale, or in the unlikely event of bankruptcy or
receivership,
your user data could be among the transferred assets. Should such a transfer occur, we will
ensure the recipient of the data is bound by privacy obligations consistent with this policy,
and we will provide notice before any personal data becomes subject to a different privacy
policy. You would then have the opportunity to review any new terms or opt out if permitted.
Importantly, aside from the scenarios above, we do not share your personal
information with third parties. In particular, we do not sell, rent, or
give away your personal
data to outside companies for their own marketing or advertising purposes. We also do not share
your specific information with unrelated third parties except with your explicit consent. Any
third parties that we do engage (as described) are there to assist us in providing the service
to you and are not allowed to use your data for their independent use.
Data Retention and Deletion
We keep your personal information only for as long as necessary to fulfill the purposes for which it
was collected, unless a longer retention period is required or permitted by law. In
practice, this
means:
-
Account Data: If you create an account, we
retain your profile information (like your email, weight/height, preferences) for as long as
your account is active. This allows us to provide you with continuous service. If you choose to
delete your account or if your account is inactive for an extended period, we will initiate
deletion of your personal data associated with that account (unless we are required to keep it
for legal reasons). Account deletion will result in removal or anonymization of personal info
from our active databases, though it may take a short period to complete, and we may retain
backup copies for a limited time (for example, in system backup archives) before those are
overwritten.
-
Usage Data: Analytics and log data are generally kept only for
as long as needed for internal analysis. We might retain aggregated analytics data (which cannot
identify a user) indefinitely for historical trend analysis. However, raw logs or device
identifiers tied to you are either deleted or anonymized after a reasonable period (for
instance, we might rotate or purge logs every 12 months) unless we need to retain them for
security audits or legal compliance.
-
Ad Data: Information collected via advertising networks (such as
advertisement impressions or clicks) is largely handled by those third-party partners. We do not
store personal ad-tracking data long term on our systems. Advertising IDs and related data on
our end are typically reset when you reinstall the App or as per your device settings.
-
Legal Retention: In certain cases, we may need to retain some
information for longer to comply with legal obligations, resolve disputes, or enforce our
agreements. For example, if we ban a user for misconduct or if we need to keep transaction
records, we might retain the necessary data in accordance with applicable laws (such as tax,
fraud prevention, or accounting regulations). During this period, the data will continue to be
protected according to this Privacy Policy.
When we no longer have a legitimate need to keep your personal information, we will
securely delete or anonymize it. If deletion is not feasible (for example, because the data is
stored in secure backups), then we will isolate it from any further use until deletion is
possible.
Your Rights and Choices
We want you to be in control of your personal information. Depending on your jurisdiction and subject
to applicable law, you may have some or all of the following rights regarding the data we hold about
you:
-
Access and Correction: You have the right to request access to
the personal data we hold about you, and to receive information about how we use it. You also
have the right to request correction of any inaccurate personal information. In the App, you can
review and update certain information directly (for example, you may edit your profile details
like weight, height, or preferences). For any data not editable through the App, you can contact
us (see Contact Us below) to make an access or correction request. We will
respond as required
by law.
-
Data Portability: In some jurisdictions (such as the European
Union under GDPR), you have the right to request a copy of the personal data you provided to us
in a structured, commonly used, and machine-readable format, and you can ask us to transmit that
data to another data controller where technically feasible.
-
Withdrawal of Consent: Where our processing of your personal
data is based on consent, you have the right to withdraw your consent at any
time. For example,
if you previously allowed us to collect precise location or to send you marketing emails, you
can withdraw that consent by disabling location access in your device settings or by
unsubscribing from marketing communications via the link provided in emails. Withdrawing consent
will not affect the lawfulness of any processing we conducted prior to your withdrawal, and it
may affect your ability to use certain features that rely on that data (for instance, turning
off location means the weather feature won't function automatically).
-
Account Deletion (Right to Erasure): You have the right to
request deletion of your personal information. If you wish to delete your account or have us
remove your data from our systems, you can use any account deletion function in the App (if
available) or contact us directly with your request. Upon verification of your identity and
request, we will delete your personal data (and your account, if applicable), except for
information we are obligated to retain for legal or legitimate business purposes. Once your data
is deleted, you will lose access to any content or services tied to that data, so please be sure
this is what you intend. We will also notify third-party service providers to delete data they
hold on our behalf, where applicable.
-
Opt-Out of Data Collection: You can choose not to provide
certain information or to disable certain data collection: for example, you may decline to give
location permission (in which case location-based features will be limited), or you can opt out
of analytics tracking by enabling any available opt-out mechanisms (some analytics SDKs honor
the “Do Not Track” or device privacy settings). Additionally, as mentioned, you can limit
targeted advertising through your device settings. While we will respect such choices, please
note that some level of data collection (such as basic device info or crash logs) may be
necessary for the App to function and maintain security.
-
California Privacy Rights (CCPA): If you are a California
resident, you have specific privacy rights under the California Consumer Privacy Act (CCPA).
These include the right to know what personal information we collect, the right to access that
information, the right to request deletion (as described above), and the right to
non-discrimination for exercising your privacy rights. As noted, we do not sell personal
information. California users can exercise their rights by contacting us with a
verifiable
request (see Contact Us below). We will handle such requests in accordance with
CCPA
requirements.
-
EU/UK Privacy Rights (GDPR): If you are in the European Union,
United Kingdom, or a similar jurisdiction with comprehensive data protection laws, you are
entitled to rights under the GDPR or equivalent regulations. These include the rights mentioned
above (access, rectification, deletion, portability, restriction of processing, and objection to
processing). You also have the right to lodge a complaint with a supervisory data protection
authority in your country if you believe we have not handled your data lawfully. We rely on the
following legal bases to process EU/UK personal data: consent (for optional
data like health
details or precise location, and for marketing communications), contract
(processing that's
necessary to provide the services you request, like using your data to deliver App features),
and legitimate interests (for improvements, analytics, and fraud prevention,
balanced with your
rights). Where we rely on consent, you can withdraw it as noted above; where we rely on
legitimate interests, you may have the right to object to our processing (particularly for
marketing or profiling purposes).
These rights may be subject to certain exemptions or limitations under law. To
exercise any applicable rights, please reach out to us (see Contact Us). We
will respond to your
request in accordance with the laws that apply to you, typically within 30 days. We may need to
verify your identity before fulfilling certain requests (for your protection).
Data Security
We are committed to protecting your personal information. We implement industry-standard security
measures to safeguard data against unauthorized access, alteration, disclosure, or destruction.
These measures include technical, administrative, and physical safeguards appropriate to the
sensitivity of the information. For example, we use encryption in transit (Secure Sockets Layer/SSL
or equivalent protocols) to protect data exchanged between the App and our servers. We restrict
access to personal data to authorized personnel and contractors who need it to operate our services
and who are bound by strict confidentiality obligations. We also regularly review our information
collection and storage practices to prevent unauthorized access.
However, please note that no method of transmission over the internet or electronic storage is 100%
secure. While we strive to protect your personal data, we cannot guarantee its absolute security. It
is important that you also play a role in keeping your information safe: use a strong, unique
password for your App account and do not share it with others. If you suspect any unauthorized
access or use of your account, please notify us immediately. We will inform you, consistent with
applicable law, if a data breach occurs that may compromise your privacy.
International Data Transfers
Our App is operated from the United States. If you are accessing the App from
outside the U.S., be
aware that your information will be transferred to and processed in the U.S. and possibly other
countries. These countries may have data protection laws that are different from (and potentially
less stringent than) the laws of your country of residence. We will take steps to ensure that your
data receives an adequate level of protection in the jurisdictions where it is processed. For
example, if we transfer personal information from the European Economic Area (EEA) or UK to the
U.S., we will rely on appropriate legal mechanisms such as Standard Contractual Clauses or other
approved safeguards to legitimize the transfer. By using the App or providing us with information,
you consent to this transfer of your information to the U.S. and other countries as applicable.
Third-Party Websites and Services
The App may contain links to third-party websites or services, or integrate third-party features that
are not operated by us (for example, a link to an external fashion blog, or social media share
buttons). If you click on a third-party link or use an integrated service, you will be directed to
that third party's site or service. This Privacy Policy does not apply to information collected by
any third-party websites or services that are outside our control. We strongly advise you to review
the Privacy Policy of every website or service you interact with. We are not responsible for the
content, privacy, or security practices of such third parties. However, if you have feedback about
third-party links shown in our App (for instance, if a link seems problematic), we welcome you to
contact us.
Changes to This Privacy Policy
We may update or modify this Privacy Policy from time to time. If we make material changes to how we
collect or use your personal information, we will notify you by posting a prominent
notice within
the App or via other communication (such as by email to the address associated with your account).
The notice will designate a reasonable advance effective date for the new terms. We encourage you to
review this Privacy Policy periodically for any updates. Changes to this Privacy Policy are
effective when they are posted here with a new “Effective Date.” Your continued use
of the App after
any changes signifies your acceptance of the revised policy. If you do not agree to the changes, you
should stop using the App and, if you wish, contact us to have your data removed.
Contact Us
If you have any questions, concerns, or requests regarding this Privacy Policy or our data
practices, please do not hesitate to contact us. We value your privacy and will respond as
promptly as possible. You can reach us at:
